General rental terms and conditions – Guadeloupe

Conditions relating to the tenant

  • The hirer must be over 21 years of age and hold a valid driving licence that has been valid for more than two years, which must be presented to the rental company along with proof of identity (identity card or passport) and proof of address dated within the last two months.
  • Drivers approved by the rental company and who meet the conditions set out in this Contract must also provide the rental company with proof of identity and a valid driving licence. Depending on the category of vehicle rented, the rental company may require the hirer to hold a driving licence of a certain category and/or to have held a driving licence for more than two years.
  • The rented vehicle may only be driven by the hirer or by any person authorised and approved by the rental company. Any subletting or loan of the vehicle to a person not authorised by the rental company is prohibited and will result in the loss of insurance and protection benefits. The natural person signing the rental agreement undertakes in their own name to comply with all the obligations described below.
  • They also commit the legal entities or companies on whose behalf they are acting and which will therefore be jointly and severally liable with them for the consequences of this contract, for which they are recognised as the apparent agent.

Conditions relating to the vehicle

  • The lessor undertakes to provide the lessee with a category of vehicle, and not a specific model or make of vehicle. The lessor declares that the vehicle is in good working order, equipped with original accessories and any optional equipment.
  • The rented vehicle has no apparent damage except for any damage specified on the condition report given to the hirer. The hirer is required to check the condition of the vehicle and the information contained in the documents provided at the time of delivery of the vehicle.
  • It is the lessee’s responsibility to check that the apparent condition of the vehicle complies with the description mentioned in the special conditions and to mention any apparent defects not reported, as well as any discrepancies in mileage, fuel level or load, at the time the vehicle is made available, so that the lessor can rectify them.
  • In the absence of such information before the hirer’s departure, the hire company shall be deemed to have delivered to the hirer a vehicle that complies with the description, and no claims for apparent defects shall be taken into account.

Fees payment terms and conditions

  • Rental rates are calculated based on the rental period, the category of the rented vehicle, and the duration of the rental. Rates are determined and vary according to the seasonality of tourist activity. Payment of the estimated rental amount will be required at the time of vehicle pick-up. Payment may be made in cash, by credit card, or by ANCV holiday vouchers. The rental company reserves the right to accept or refuse bank checks as a means of payment.
In addition to the base price, the renter shall be liable for the following fees or charges, where applicable: additional amounts for optional equipment; the security deposit, which will be refunded to the renter at the end of the contract if all obligations have been met; taxes and duties applicable to the aforementioned payments; any fines, penalties, surcharges, and related fees charged to the renter; costs for breakdown assistance, tolls, parking, repatriation, or immobilization when the renter is at fault; the deductible reduction option, if subscribed; fuel costs, including any missing amount if the vehicle is not returned with a full tank; additional kilometers at the rate specified in the contract in case of exceeding the maximum mileage included in the package; the “extra day” rate specified in the contract if the vehicle is returned after the agreed-upon time stated in the contract, noting that any day begun is fully due; late arrival fees applied beyond the agency’s closing hours; insurance deductibles, appraisal and repair costs for damages not covered by insurance, as well as the rental company’s loss of income in case of vehicle immobilization; repair costs related to the loss or damage of the vehicle’s keys by the renter; costs related to tire repair or replacement due to damage caused by the renter; the full amount of damages suffered by the rental company in cases of exclusion or forfeiture of insurance coverage; in the event of a breakdown or accident for which the renter is responsible, they agree to cover all towing costs incurred. The renter agrees to pay all expenses related to vehicle repairs.

Use of the vehicle

The lessee has custody of the vehicle in accordance with the provisions of Article 1242 – paragraph I of the Civil Code and must therefore ensure its use, management and control as a ‘reasonable person’. The lessee undertakes to use the rented vehicle with due care and attention, in compliance with the laws and regulations in force, for lawful and non-commercial purposes. The lessee is solely responsible for the vehicle and the consequences that may result from its use.

The hirer is liable for any traffic offences or other breaches of the laws or regulations in force committed during the rental period. The hirer undertakes to take all necessary protective measures to keep the vehicle in the same condition as when it was taken into possession, in order to prevent any damage or theft of the vehicle. The rented vehicle may only be used in the department of Guadeloupe. It is forbidden to transport it on a boat. The vehicles are non-smoking and in the event of non-compliance with this condition, the hirer undertakes to pay the cleaning and deodorisation costs.

Deposit

EIn addition to the rental payment, a deposit is required to collect the vehicle. This can only be paid by credit card. All bank cards are accepted except debit cards such as VISA ELECTRON, MAESTRO, NICKEL, REVOLUT, etc. The depositor must be the holder of the card left as a deposit and be the driver named on the rental agreement.

  • If this deposit is made by another person, that person must be present, be able to prove their identity and be the holder of the bank card. They must be added to the contract by subscribing to the ‘second driver’ option and paying the price of this option.
 

Insurance — supplementary cover — exclusion

The vehicle must be returned in the same condition as when it was jointly inspected by the renter at the time of departure from the agency. Any repair costs resulting from the renter’s fault will be borne by them. It is the renter’s responsibility to provide proof that the rented vehicle has been returned to the agency. The fuel level must be restored upon return of the vehicle. Otherwise, refueling fees will be charged.

For vehicles in categories A to C, a penalty of €15 per missing fuel bar will be charged, and for higher-category vehicles, the penalty will be €18 per missing bar. The vehicle must be returned in the same level of cleanliness as at departure. Any vehicle returned in an unclean condition will be subject to cleaning fees depending on its category. The cleaning package is an optional service that can be subscribed to at the beginning, during, or at the end of the rental period.

Termination

The rental agreement may be terminated by either party in the event of a breach by the other party of its essential obligations hereunder. Notwithstanding such termination, the parties shall retain the right to claim compensation for damages suffered as a result of the other party’s breach of the contractual provisions. Termination shall take effect 8 days after the sending of a formal notice to remedy the breach, which has remained unsuccessful.

In the event of termination, the vehicle must be returned by the lessee to the lessor at their own expense and risk on the dates and at the times indicated in the termination letter. If the vehicle is not returned on the date indicated, any liability limitations and optional insurance taken out will no longer apply. The hirer will also be liable for the sums mentioned in Article 6, except in cases where the failure to return the vehicle is not the fault of the customer (force majeure or the act of a third party).

Returning the vehicle

All rented vehicles are covered by third-party liability insurance in accordance with current regulations, and its cost is included in the rental fee. This insurance covers material and bodily damage that the renter may cause to third parties while using the vehicle or otherwise. Third-party liability insurance does not cover bodily injury or death suffered by the renter, any damage caused to the renter’s own property or personal belongings, any damage to the vehicle itself, or theft of the vehicle.

Third-party liability insurance also does not apply to damages caused by the renter or authorized driver to their employees or representatives; damages suffered by passengers when transportation conditions do not meet the safety standards described in Article A.211-3 of the French Insurance Code; if, at the time of the incident, the renter’s or authorized driver’s license is invalid or suspended; generally, to events excluded from coverage under Articles R.211-10 and R.211-11 of the Insurance Code; in cases of intentional or fraudulent acts under Article L.113-1 of the Insurance Code; when the rented vehicle is used for automotive or sporting tests or competitions; in cases of attempted fraud; or in cases of false declarations regarding the renter’s or any authorized driver’s personal information specified in the rental agreement.

Our rental rates also include: driver coverage, damage insurance with a variable deductible (depending on the repair estimate), theft insurance with a fixed deductible, and coverage for transported passengers. In the event of subscribing to the deductible reduction option, the insurance covers bodywork, headlights, and tail lights. It excludes windshield damage, underbody impact, roof damage, and the loss or deterioration of the vehicle’s key.

Cancellation — Refund

For any withdrawal or cancellation of a booking, the sums paid by the customer will not be refunded and will be forfeited. This sum may be converted into a credit note valid for one year. In the event of death, upon presentation of proof, a refund may be provided on the sum paid. In the event of early return of the vehicle during a rental period, the unused days will not be refunded. However, a credit note may be offered, valid for one year from the date on which the credit note is issued.
